The Director of the F.B.I. Adds His Two Cents

I wasn’t surprised when James Comey, head of the F.B.I., announced that Hillary Clinton would not face criminal charges as a result of her email practices. But I was relieved. There was always the possibility that Comey, a Republican, might complicate the election by calling for an indictment. So it was good news when Comey said:

….no reasonable prosecutor would bring such a case…. In looking back at our investigations into mishandling or removal of classified information, we cannot find a case that would support bringing criminal charges on these facts.

That could have been the end of the matter. The F.B.I.’s job was to determine the facts and make a recommendation to the Attorney General. In this case, the recommendation was: “No prosecution is called for”.

But Comey had much more to say that morning (actually he had 2,300 words to say in his prepared statement). In an attempt at explanation, he included this preamble:

This will be an unusual statement in at least a couple ways. First, I am going to include more detail about our process than I ordinarily would, because I think the American people deserve those details in a case of intense public interest. Second, I have not coordinated or reviewed this statement in any way with the Department of Justice or any other part of the government. They do not know what I am about to say.

As you’ve probably heard, Comey then went into some detail about what the F.B.I. found. He also strongly criticized Clinton for being careless with national security (although no actual breach of national security was detected) and offered critiques of some of Clinton’s statements.

Immediately, what seemed like a good day for Clinton seemed like a very bad day. Reporters and pundits repeated Comey’s language about carelessness and drew conclusions about the negative effects the F.B.I. director’s remarks would have. One reporter for the New York Times went so far as to write a theoretical attack ad for Trump’s campaign. It was presented on the front page of the Times as “news analysis”.

Since then, of course, the Republicans have strongly criticized Comey’s recommendation that Clinton not be prosecuted. And other facts have come out. For example, it turns out that some of the information that was labeled “classified” shouldn’t have been, according to the State Department, and that the labeling wasn’t done according to the rules in a clearly visible way.

Compared to the other issues we’re confronting, and considering who Clinton is running against, it’s possible that the email issue will fade away as the election approaches and our ballots are finally cast. (I’ve always thought this story was mainly interesting because it demonstrates how too much information is “classified” by overzealous government employees.) Nevertheless, after the initial blast of “analysis”, I saw an article and a letter to the editor that characterized Comey’s two-thousand-word statement in an interesting way.

The article in The Washington Post was written by a former director of the Justice Department’s public affairs office. It’s called “James Comey’s Abuse of Power” and is worth quoting at length:

When FBI Director James B. Comey stepped to the lectern to deliver his remarks about Hillary Clinton on Tuesday, he violated time-honored Justice Department practices for how such matters are to be handled, set a dangerous precedent for future investigations and committed a gross abuse of his own power.

…his willingness to reprimand publicly a figure against whom he believes there is no basis for criminal charges should trouble anyone who believes in the rule of law and fundamental principles of fairness.

Justice Department rules set clear guidelines for when it is appropriate for the government to comment about individuals involved in an ongoing investigation, which this matter was until prosecutors closed it Wednesday. Prosecutors and investigators can reassure the public that a matter is being taken seriously, and in some rare cases can provide additional information to protect public safety, such as when a suspect is loose and poses a danger.

And when the department closes an investigation, it typically does so quietly, at most noting that it has investigated the matter fully and decided not to bring charges.

These practices are important because of the role the Justice Department and FBI play in our system of justice. They are not the final adjudicators of the appropriateness of conduct for anyone they investigate. Instead, they build cases that they present in court, where their assertions are backed up by evidence that can be challenged by an opposing party and ultimately adjudicated by a judge or jury.

In a case where the government decides it will not submit its assertions to that sort of rigorous scrutiny by bringing charges, it has the responsibility to not besmirch someone’s reputation by lobbing accusations publicly instead. Prosecutors and agents have followed this precedent for years.

In this case, Comey ignored those rules to editorialize about what he called carelessness by Clinton and her aides in handling classified information, a statement not grounded in any position in law. He recklessly speculated that Clinton’s email system could have been hacked, even while admitting he had no evidence that it was. This conjecture, which has been the subject of much debate and heated allegations, puts Clinton in the impossible position of having to prove a negative in response….

While Clinton shouldn’t have received special treatment, she does not deserve worse treatment from her government than anyone else, either. Yet by inserting himself into the middle of a political campaign and making unprecedented public assertions, that is exactly what Comey provided.

Finally, a professor of legal ethics at the New York University school of law wrote this letter to The Times:

James B. Comey, the F.B.I. director, was out of line in holding a press briefing to deliver his verdict on Hillary Clinton’s use of a private server. The F.B.I. investigates crime and reports its findings and recommendations to federal prosecutors, who then decide whether to seek indictments.

The F.B.I. is neither judge nor jury. And it certainly has no business characterizing the noncriminal conduct of subjects of investigation, as Mr. Comey did. Cops, even top cops, should not play this role.

While it may gratify the country to hear Mr. Comey’s independent views on the server controversy, his press briefing sets a bad precedent that can harm the fair administration of justice. Few people under investigation have the resources Mrs. Clinton has to defend herself….

Once a decision is made not to indict, a prosecuting agency should say nothing more. Its job is to prosecute crime, and if there is no crime, it should remain silent.

My conclusion is that Comey’s statement was unusual in a way he didn’t think to mention, i.e., it was wrong for him to make it.

German Leaders Thought Hitler Was Trump

Jonathan Chait of New York Magazine asks why leading Republicans are supporting Trump and finds the answer in 1933:

“Like Hitler, Trump is a radical, authoritarian figure who lies outside the normal parameters of his country’s conservative governing class. Thus, there is a parallel between the two men’s unexpected rise to power that is worth considering: Why would traditional conservatives willingly hand power to a figure so dangerous that he threatened their own political and economic interests? Why, having failed in their halfhearted efforts to nominate an alternative candidate during the primaries, don’t they throw themselves behind a convention coup, a third-party candidacy, or defect outright to Hillary Clinton? Why do so many of them consider Trump the lesser rather than the greater evil?”

“….In January 1933, the Nazi party’s vote share had begun to decline, and its party was undergoing a serious internal crisis, with dues falling, members drifting off, and other leaders questioning Hitler’s direction. A widely shared belief across the political spectrum at the time held that Hitler would not and could not win the chancellorship….”

“Hindenburg and the German right viewed Hitler in strikingly similar terms to how Republican elites view Trump….Alfred Hugenberg, leader of the German-Nationals, deemed the Nazis “little better than a rabble, with dangerously radical social and economic notions…Hindenburg considered Hitler qualified to head the postal ministry at best. Hitler, in their eyes, was not a serious man, unfit to govern, a classless buffoon. His appeal, the German elite believed, came from his outsider status, which allowed him to posture against the political system and make extravagant promises to his followers that would never be tested against reality.”

“All this is to say that German conservatives did not see Hitler as Hitler — they saw Hitler as Trump. And the reasons they devised to overcome their qualms and accept him as the head of state would ring familiar to followers of the 2016 campaign. They believed the responsibility of governing would tame Hitler, and that his beliefs were amorphous and could be shaped by advisers once in office. They respected his populist appeal and believed it could serve their own ends….Their myopic concern with specifics of their policy agenda overcame their general sense of unease….Think of the supply-siders supporting Trump in the hope he can enact major tax cuts, or the social conservatives enthused about his list of potential judges, and you’ll have a picture of the thought process….”

“Whatever norms or bounds that we think limit the damage a president could inflict are likely to be exceeded if that president is Trump. Those Republicans who publicly endorse Trump because he probably won’t win may be making an error on a historic scale.”

Trump, the Christian

Peter Wehner had various jobs in the last three Republican administrations. Now he works at a conservative think tank called the Ethics and Public Policy Center. Ordinarily, I wouldn’t pay much attention to what he has to say about anything, but his thoughts on “The Theology of Donald Trump” are worth reading. 

After Mr. Trump met with hundreds of evangelical Christians a couple of weeks ago, James Dobson, who is among the most influential leaders in the evangelical world and serves on Mr. Trump’s evangelical executive advisory board, declared that “Trump appears to be tender to things of the Spirit,” by which Dr. Dobson meant the Holy Spirit.

Of all the descriptions of Mr. Trump we’ve heard this election season, this may be the most farcical. As described by St. Paul, the “fruit of the Spirit” includes forbearance, kindness, goodness, faithfulness, gentleness and self-control, hardly qualities one associates with Mr. Trump. It shows you the lengths Mr. Trump’s supporters will go to in order to rationalize their enthusiastic support of him….

The calling of Christians is to be “salt and light” to the world, to model a philosophy that defends human dignity, and to welcome the stranger in our midst. It is to stand for justice, dispense grace and be agents of reconciliation in a broken world. And it is to take seriously the words of the prophet Micah, “And what does the Lord require of you but to do justly, and to love kindness and mercy, and to humble yourself and walk humbly with your God?”

Evangelical Christians who are enthusiastically supporting Donald Trump are signaling, even if unintentionally, that this calling has no place in politics and that Christians bring nothing distinctive to it — that their past moral proclamations were all for show and that power is the name of the game.

Trump’s success demonstrates beyond any doubt that millions of Republicans are morally bankrupt, despite their claims to cherish rock-solid moral values. The support Trump is receiving from “Christian” leaders demonstrates that they are morally bankrupt too, no matter how much they claim to foster Christian values.

Clinton and Krugman on Trump and Workers

As you might expect, Hillary Clinton’s campaign site has a lot of policy proposals. By my count, the “Issues” page has thirty-two topics you can click on to see what she wants to do as President. (Oddly, the only issues listed are domestic. There’s no page for foreign policy.)

Among the issues are “Fixing America’s Infrastructure”, “Labor and Workers’ Rights” and “Workforce Skills and Job Training”, but the one that I was especially interested in was “Manufacturing”. If you click on it, you’ll see that Clinton offers some sensible suggestions to increase manufacturing jobs in this country. However, it’s highly unlikely America will ever be the manufacturing powerhouse it used to be. Yesterday’s column by Paul Krugman explains why and also explains why Trump is no friend of working people, despite his tough talk on trade:

There’s no question that rising imports, especially from China, have reduced the number of manufacturing jobs in America…. My own back-of-the-envelope calculation suggests that completely eliminating the U.S. trade deficit in manufactured goods would add about two million manufacturing jobs.

But America is a big place, and total employment exceeds 140 million. Shifting two million workers back into manufacturing would raise that sector’s share of employment back from around 10 percent to around 11.5 percent. To get some perspective: in 1979, on the eve of the great surge in inequality, manufacturing accounted for more than 20 percent of employment. In the 1960s it was more than 25 percent…Trumponomics wouldn’t come close to bringing the old days back.

No matter what we do on trade, America is going to be mainly a service economy for the foreseeable future. If we want to be a middle-class nation, we need policies that give service-sector workers the essentials of a middle-class life. This means guaranteed health insurance — Obamacare brought insurance to 20 million Americans, but Republicans want to repeal it and also take Medicare away from millions. It means the right of workers to organize and bargain for better wages — which all Republicans oppose. It means adequate support in retirement from Social Security — which Democrats want to expand, but Republicans want to cut and privatize.

….And it should go without saying that a populist agenda won’t be possible if we’re also pushing through a Trump-style tax plan, which would offer the top 1 percent huge tax cuts and add trillions to the national debt.

Sorry, but adding a bit of China-bashing to a fundamentally anti-labor agenda does no more to make you a friend of workers than eating a taco bowl does to make you a friend of Latinos.

Class In America

Nancy Isenberg, a history professor at Louisiana State, identifies five myths about class in America. Instead of listing the myths, I’ll turn them around and present the corresponding truths: 

  1. The working class isn’t mostly white and male
  2. Most Americans notice class differences
  3. America has less class mobility than other developed countries
  4. Talent and hard work make it easy to rise above your class
  5. Racial oppression is more serious than class oppression

My favorite paragraph:

Class power takes many forms. Its enduring force, its ability to project hatred toward the lower classes, was best summed up by two presidents 175 years apart. In 1790, then-Vice President John Adams argued that Americans not only scrambled to get ahead; they needed someone to disparage. “There must be one, indeed, who is the last and lowest of the human species,” he wrote. Lyndon Johnson came to the same conclusion in explaining the racism of poor whites: “If you can convince the lowest white man he’s better than the best colored man, he won’t notice you’re picking his pocket. Hell, give him somebody to look down on, and he’ll empty his pockets for you.”
