The Election, and More Democracy in Chains

It’s taken almost a month to count almost all the ballots. We now know that the Democrats did extremely well in November’s election. Nationwide, Democratic candidates received 59.5 million votes against 50.5 million for the Republicans. A 9-million vote margin is the largest in the history of midterm elections. Winning 53% of the vote against 45% for the Republicans was the biggest percentage difference in a midterm election since 1974, the year Nixon resigned.

As a result, the Democrats took control of the House of Representatives, winning 235 seats to the Republicans’ 200. They also won many state and local races. One result is that most Americans will have Democratic governors starting in January. The Democrats might have taken the U.S. Senate but for the fact that they were defending 26 seats in this election vs. 9 seats for the Republicans. Ten of those Democratic seats were especially vulnerable, representing states that voted for the candidate now known in various indictments and plea agreements as “Individual-1”.

What nobody knows is how well the Democrats would have done if Republican efforts at voter suppression hadn’t been so successful. The Center for American Progress published a long article two weeks ago on “Voter Suppression in the 2018 Midterm Elections”. The authors discuss voter registration problems, voter purges, strict ID and ballot requirements, misleading instructions, malfunctioning equipment, intimidation, harassment, poll closures and long lines, as well as gerrymandering. The authors are too polite to say so, but Republican officials were responsible for each example of bad behavior they cite.

An article from Vox describes what went on in two large southern states:

For example, in Georgia, Republican gubernatorial candidate Brian Kemp used his position as secretary of state to purge an estimated 107,000 people from the voter registration rolls just because they had not voted recently — with the majority of counties purging black voters at higher rates than whites. He put another 53,000 voter registration applications “on hold” — 70 percent of which were from black Georgians. And when people showed up to vote in predominantly black counties, they faced impossibly long lines produced by the closure of 214 polling places since 2012, as well as faulty voting machines. Later, we would learn that 700 voting machines were left wrapped and unused in a nearby warehouse in Atlanta.

All of this happened on top of Georgia’s existing strict voter ID law, which imposed an additional barrier to voting that disproportionately disadvantaged black voters. Nationwide, 25 percent of black Americans lack government-issued photo ID, compared to only 8 percent of whites. A variety of systemic barriers make it harder for people of color to obtain a photo ID. For example, many older black residents lack birth certificates or other required documentation to get an ID. As a consequence, strict voter ID laws like Georgia’s have been shown to significantly and disproportionately reduce turnout among black and brown voters.

Similar issues were reported in Florida, where in addition to purges and polling place closures, there were widespread reports suggesting thousands of voters never received the absentee ballots they requested, and absentee ballots that were submitted by black and Latinx voters were rejected at higher rates due to “signature mismatch”.

Was it a coincidence that the Republican candidates for governor won close elections in both states last month?

The fact is that voter suppression has been official and unofficial Republican policy for decades. I just finished reading Democracy In Chains, a book I wrote about two weeks ago. The key sentence in its 235 pages of text is the one in which the author quotes a Nobel Prize-winning economist named James Buchanan. The late Mr. Buchanan deserves to be known as the intellectual godfather of today’s Republican Party. He is quoted as saying that what we Americans need to do is to get rid of “the sacrosanct status of majority rule”. Minority rule, assuming it’s the right minority, would be much better. That sums up today’s radical Republican Party.

Democracy in Chains: The Deep History of the Radical Right’s Stealth Plan for America by Nancy MacLean

If you want to understand American politics, read this book. Professor MacLean is the William H. Chafe Professor of History and Public Policy at Duke University. Democracy In Chains was a finalist for the 2017 National Book Award and was named by The Nation as the most valuable book of the year.

The book is “deep history” because MacLean delves into the relatively obscure career of an American economist named James Buchanan. She shows how Buchanan’s teachings, beginning in the 1950s, were adopted by right-wing ideologues and eventually came to dominate the thinking of wealthy, powerful and well-connected Republicans all over America.

She uses the phrase “radical right” because today’s Republican Party is radically different from the Republican Party of the 1950s. The party’s leaders used to be conservative. Now they’re bound to an ideology that elevates property rights over almost all other considerations.The party’s guiding principal is that any infringement on a person’s right to accumulate wealth is inherently unfair. Human freedom consists in making money and holding on to it. Nothing is more important when it comes to political policy. In fact, taxation is only justified for national defense and otherwise maintaining order. This is not a conservative position. It’s a so-called “libertarian” position that translates into extreme policies unacceptable to most Americans.

There is indeed a “stealth plan”. MacLean shows how this plan was developed,  and how it was paid for by people like the billionaire Charles Koch. Its goal is to make the United States a very different country. She explains how various academics, lawyers and political operatives, often working for right-wing publications, business groups or think tanks, have been working together for decades to move America to the right, while being secretive about their ultimate goal.

Their many public goals are well-known by now. These goals include lower taxes for the wealthy, minimal regulation of business activity, less funding for social programs (the ones that can’t be eliminated entirely), greater influence of money on our politics, and the privatization of as many government services as possible, including schools, prisons and the military. They also support ever-increasing spending on the military budget and fewer restrictions on the police, so that everyone, here and abroad, is kept in line.

Their overarching goal is much less publicized. It’s to interfere with majority rule. The economist James Buchanan argued strongly that the majority cannot be trusted. Most people want the government to do things that benefit the nation as a whole. They like well-funded public schools, well-maintained public roads, government assistance for the poor, decent medical care for the sick, and clean air and water for everyone.

But those things have to be paid for. That means the government has to collect taxes. Taxes, however, are unfair, since they involve taking property (i.e. money) from people who would rather keep it. Therefore, Buchanan and his ilk concluded, the wrong people should not be allowed to vote. And if the majority does vote for “non-libertarian” policies, the courts should rule those policies unconstitutional. Thus, we see voter suppression and gerrymandering, and undemocratic actions like changing the rules so that newly-elected Democrats will have less power when they take office.

At times, the story MacLean tells is hard to believe. But the story is true. I’ll conclude with an example and a summary from Professor MacClean:

Again and again, at every opportunity he had, [Buchanan] told his allies that no “mere changing of the political guard will suffice”, that “the problems of our times require attention to the rules rather than the rulers. And that meant that real change would come “only by Constitutional law”. The project [i.e. the stealth plan] must aim toward the practical “removal of the sacrosanct status assigned to majority rule”... [184].

“Who will care for America’s children and the elderly”, [historian Ruth Rosen] asks, now that … “market fundamentalism — the irrational belief that markets solve all problems — has succeeded in dismantling so many federal regulations, services and protections?” But the cause [i.e. the plan] would argue that it has answered that question over and over again: You will. And if you can’t, you should have thought of that before you had kids or before you grew old without adequate savings. The solution to every problem … is for each individual to think, from the time they are sentient, about their possible future needs and prepare for them with their own earnings, or pay the consequences [221].

That is the kind of thinking we, the majority, are up against.

Democracy in Chains

Publishers and book critics sometimes say a particular book is one that every American, or every thinking American, or every American who cares about such and such, should read. I’m reading one of them now. If you want to understand U.S. politics, you should read Democracy in Chains: The Deep History of the Radical Right’s Stealth Plan for America. It’s by Nancy MacLean, a professor of history and public policy at Duke University.

MacClean explains how a small group of libertarian and conservative academics began a movement in the 1950s that eventually led to the rightward shift in American politics. So many on the right are so deeply committed to low taxes, privatization, deregulation and making it hard (for some people) to vote because, to borrow a phrase from John Maynard Keynes, they are “the slaves of some defunct  economist[s] … distilling their frenzy from some academic scribbler[s] of a few years back”.

This radical right-wing agenda favors property over democracy. They hate the idea that a majority of voters can elect politicians who will interfere with a rich person’s right to accumulate and keep as much stuff as possible. As a result, they look  for ways to dilute the majority’s ability to effect change.

MacClean discusses one case in which the right’s “stealth program” was implemented. The key figure in her book, a Virginia Tech economist named James Buchanan, helped transform Chile after Gen. Augusto Pinochet led a military coup in 1973:

For it was Buchanan who guided Pinochet’s team in how to arrange things so that [Chile’s] capitalist class would be all but permanently entrenched in power….

If Jim Buchanan had qualms about helping to design a constitution for a dictatorship or the process by which [it] was ratified, … he did not commit them to print…

What’s perplexing is how a man whose life’s mission was the promotion of what he … called the free society reconciled himself … to what a military junta was doing to the people of Chile. The new Chile was free for some, … the same kind of people who counted in Virginia in the era when [Buchanan fought desegregation]. It was also, always, a particular kind of freedom the libertarians cared most about. One Chilean [rejoiced] that “the individual freedom to consume, produce, save and invest has been restored”.

… Chile emerged with a set of rules closer to his ideal than any in existence, built to repel future popular pressure for change. [The new constitution] was a “virtually unamendable charter”, … radically skewed by the over-representation of the wealthy, the military and the less popular political parties associated with them. Buchanan had long called for binding rules to protect economic liberty and constrain majority power, and [the constitution] guaranteed these as never before”.

Among the right-wing “reforms” instituted by the Pinochet dictatorship were lower taxes for corporations and the wealthy, devastating restrictions on unions, privatization of the social security system, privatization of health care, a less independent judicial system, limits on the government’s ability to issue regulations, school vouchers in place of funding for public education and forcing state universities to become “self-financing”. If this list of “modernizations” sounds familiar, it should. It’s the public agenda of today’s Republican Party.

Since it isn’t good public relations for a political party or government to say it’s against majority rule, however, the right’s intention to install and maintain minority rule isn’t publicly stated. But after seizing power, Pinochet ruled as a dictator for years. In the U.S., the right-wing justices on the Supreme Court have given more political power to corporations and the rich, while undermining the 1965 Voting Rights Act; and Republican politicians in states like Florida, Georgia and Wisconsin have made it less likely that poor people and certain minorities will vote, all the while claiming they are only interested in fighting a phenomenon, voter fraud, which they know is extremely rare.

The good news is that the resurgent Democratic Party is dedicated to making voting easier and more representative. In addition, there are efforts underway in a number of states to eliminate gerrymandering of congressional districts and to make the undemocratic Electoral College irrelevant. Others are calling for the citizens of Puerto Rico and the District of Columbia to be given full voting rights. Changes will come eventually, since the majority still has some power. How It Is and How It Got This Way (26 Days)

Our new Supreme Court Justice, Bart O’Kavanaugh, the noted liar, aka the Keg Meister, took a hard line in his first appearance with the court. He said an immigrant who committed a minor crime thirty years ago and did his time is still subject to being locked up. Even his right-wing colleague, Neil Gorsuch, didn’t go that far:

The question in the case was whether the federal authorities must detain immigrants who had committed crimes, often minor ones, no matter how long ago they were released from criminal custody. Justice Kavanaugh said a 1996 federal law required detention even years later, without an opportunity for a bail hearing.

“What was really going through Congress’s mind in 1996 was harshness on this topic,” he said.

But Justice Gorsuch suggested that mandatory detentions of immigrants long after they completed their sentences could be problematic. “Is there any limit on the government’s power?” he asked.

Now we know O’Kavanaugh will take bad behavior seriously even if it happened thirty years ago, as long as it allows him to make life difficult for an immigrant.

Who Gets to Rule a Nation? The Rise of the One-Party State

A government in which one person has unlimited power is an autocracy. A government in which a small group has a great deal of power is an oligarchy. Unlike an autocracy, there is no requirement that oligarchs have unlimited power. Here in the United States, we still have a representative democracy, although lately it’s been veering toward oligarchy. We also have a president who would prefer America as autocracy with himself as the autocrat.

Anne Applebaum has written a long article for The Atlantic that explains the form of government that’s on the rise around the world. Her article is labeled this way:

Polarization. Conspiracy theories. Attacks on the free press. An obsession with loyalty. Recent events in the United States follow a pattern Europeans know all too well.

Whether such governments are autocracies or oligarchies isn’t clear-cut. She suggests “single-party” or “one-party state”. The paragraphs below explain how they work and how their adherents justify them. Reading the article helped me understand the current crisis.

[Who gets to rule a nation?] For a long time, we have imagined that these questions were settled—but why should they ever be?

Monarchy,tyranny, oligarchy, democracy—thesewere all familiar to Aristotle more than 2,000 years ago. But the illiberal one-party state, now found all over the world—think of China, Venezuela, Zimbabwe—was first developed by Lenin, in Russia, starting in 1917. In the political-science textbooks of the future, the Soviet Union’s founder will surely be remembered not for his Marxist beliefs, but as the inventor of this enduring form of political organization. It is the model that many of the world’s budding autocrats use today.

Unlike Marxism, the Leninist one-party state is not a philosophy. It is a mechanism for holding power. It works because it clearly defines who gets to be the elite—the political elite, the cultural elite, the financial elite. In monarchies such as pre-revolutionary France and Russia, the right to rule was granted to the aristocracy, which defined itself by rigid codes of breeding and etiquette. In modern Western democracies, the right to rule is granted, at least in theory, by different forms of competition: campaigning and voting, meritocratic tests that determine access to higher education and the civil service, free markets. Old-fashioned social hierarchies are usually part of the mix, but in modern Britain, America, Germany, France, and until recently Poland, we have assumed that competition is the most just and efficient way to distribute power. The best-run businesses should make the most money. The most appealing and competent politicians should rule. The contests between them should take place on an even playing field, to ensure a fair outcome.

Lenin’s one-party state was based on different values. It overthrew the aristocratic order. But it did not put a competitive model in place. The Bolshevik one-party state was not merely undemocratic; it was also anti-competitive and anti-meritocratic. Places in universities, civil-service jobs, and roles in government and industry did not go to the most industrious or the most capable. Instead, they went to the most loyal. People advanced because they were willing to conform to the rules of party membership. Though those rules were different at different times, they were consistent in certain ways. They usually excluded the former ruling elite and their children, as well as suspicious ethnic groups. They favored the children of the working class. Above all, they favored people who loudly professed belief in the creed, who attended party meetings, who participated in public displays of enthusiasm. Unlike an ordinary oligarchy, the one-party state allows for upward mobility: True believers can advance. As Hannah Arendt wrote back in the 1940s, the worst kind of one-party state “invariably replaces all first-rate talents, regardless of their sympathies, with those crackpots and fools whose lack of intelligence and creativity is still the best guarantee of their loyalty.”

Lenin’s one-party system also reflected his disdain for the idea of a neutral state, of apolitical civil servants and an objective media… In the Bolshevik imagination, the press could be free, and public institutions could be fair, only once they were controlled by the working class—via the party.

This mockery of the competitive institutions of “bourgeois democracy” and capitalism has long had a right-wing version, too. Hitler’s Germany is the example usually given. But there are many others. Apartheid South Africa was a de facto one-party state that corrupted its press and its judiciary to eliminate blacks from political life and promote the interests of Afrikaners, white South Africans descended mainly from Dutch settlers, who were not succeeding in the capitalist economy created by the British empire.In Europe, two such illiberal parties are now in power: Law and Justice, in Poland, and Viktor Orbán’s Fidesz party, in Hungary. Others, in Austria and Italy, are part of government coalitions or enjoy wide support. These parties tolerate the existence of political opponents. But they use every means possible, legal and illegal, to reduce their opponents’ ability to function and to curtail competition in politics and economics. They dislike foreign investment and criticize privatization, unless it is designed to benefit their supporters. They undermine meritocracy. Like Donald Trump, they mock the notions of neutrality and professionalism, whether in journalists or civil servants. They discourage businesses from advertising in “opposition”—by which they mean illegitimate—media.

Notably, one of the Law and Justice government’s first acts, in early 2016, was to change the civil-service law, making it easier to fire professionals and hire party hacks. The Polish foreign service also wants to drop its requirement that diplomats know two foreign languages, a bar that was too high for favored candidates to meet. The government fired heads of Polish state companies. Previously, the people in these roles had had at least some government or business experience. Now these jobs are largely filled by Law and Justice Party members, as well as their friends and relatives….

You can call this sort of thing by many names: nepotism, state capture. But if you so choose, you can also describe it in positive terms: It represents the end of the hateful notions of meritocracy and competition, principles that, by definition, never benefited the less successful. A rigged and uncompetitive system sounds bad if you want to live in a society run by the talented. But if that isn’t your primary interest, then what’s wrong with it?

If you believe, as my old friends now believe, that Poland will be better off if it is ruled by people who deserve to rule—because they loudly proclaim a certain kind of patriotism, because they are loyal to the party leader, or because they are … a “better sort of Pole”—then a one-party state is actually more fair than a competitive democracy. Why should different parties be allowed to compete on an even playing field if only one of them has the moral right to form the government? Why should businesses be allowed to compete in a free market if only some of them are loyal to the party and therefore deserving of wealth?

Forewarned is forearmed. Please vote for Democrats up and down the ballot in November’s mid-term election. And convince your reasonable friends to vote if any of them still need convincing.
